Artwork Warranty and Returns

Kathryn takes pride in each piece she makes, and we want you to be completely happy with your purchase. If you are not happy with your artwork for any reason, you can return it within 14 days for a full refund including shipping costs. Contact us by replying to your original order email and we’ll arrange the return shipping.

If you have a problem with existing art, contact us. All artwork is subject to normal wear and tear through use, storage, cleaning and exposure to sunlight and temperature fluctuations.

Though it is not standard in the industry to offer any warranty on artwork past the initial purchase period, we offer a limited 5 year warranty on materials and workmanship (art storage and care are outside of our control). Artwork will be shipped with a care and information card so you can ensure your art will last as long as possible. Contact us with any questions you have about caring for your artwork.  Disclaimer of Warranties

For only physical items that you purchase and receive through your use of the Website and excluding all other content, products, and services on the Website, (“Purchased Art”), Beals Studios will warrant the Purchased Art for a period of five (5) years from the date of your purchase, ONLY against manufacturer defects in material and/or workmanship. 

You acknowledge and agree that the foregoing warranty of Purchased Art does not Cover: 

1. Any damage to Purchased Art caused by neglect, abuse, or natural wear and tear. 

2. Any Purchased Art that has been repaired or modified in any way.

3. Any lost or stolen Purchased Art. 

4. Any claim made by anyone other than the original purchaser of the Purchased Art.

5. Anything other than Purchased Art as defined above.

If you need to return Purchased Art due to defects covered and not excluded by this warranty of Purchased Art, please contact us so that we may give you instructions on sending us the item. We will carefully examine the Purchased Art and determine, in our sole discretion, if the defect is covered by this Warranty or not. If we determine that the defect is covered by this warranty, we will provide you with a refund for, or replacement of, the Purchased Art within 10 days of our determination that the defect is covered by this Warranty.

All shipping, handling, taxes, and duties related to this warranty of the Purchased Art (and replacements, if any), both to us for our review and return of the Purchased Art or replacement to you will be exclusively paid for by you and we are not responsible for such charges.

Arbitration

At Company's sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
